Welcome to read the "Terms of Service" (hereinafter referred to as "this Agreement"). The terms and conditions stated in this Agreement apply to your (hereinafter referred to as "user") use of various products and services of the APP.
1. Confirmation of Service Agreement
1.1 We agree to provide FrameElf APP and related services (hereinafter referred to as "FrameElf") based on the internet and mobile network according to the provisions of this Agreement and its operational rules published from time to time.
1.2 FrameElf users (hereinafter referred to as "users") should understand the entire content of this Agreement, independently consider and accept all terms of this Agreement, and complete the entire registration process according to the prompts on the page. Users' registration, login, and usage behaviors will be considered as complete acceptance of this Agreement and all rules and regulations we publish.
1.3 We have the rights of supervision, prompt, inspection, correction, and other rights over all activities on the FrameElf APP.
2. Service Content
2.1 The specific content of FrameElf services is provided by us according to actual situations, including but not limited to authorizing users to upload, search, and push relevant information to interconnected users through their accounts, authorizing users to collect and share them, etc. We have the right to upgrade or otherwise adjust the services or product forms we provide, which will be notified to users through APP/website content updates, without separate notification to users.
2.2 Our services may include advertisements, and users agree to display advertisements and advertisements provided by third-party suppliers and partners during use.
2.3 We only provide technical services related to FrameElf services, etc. Apart from this, equipment related to network services (such as personal computers, mobile phones, and other devices related to internet or mobile network access) and required fees (such as telephone fees and internet fees paid for internet access, mobile phone fees paid for using mobile network) shall be borne by users themselves.
3. Service Changes, Interruption, or Termination
3.1 Given the special nature of network services (including but not limited to force majeure, network stability, system stability, technical failures, user location, user shutdown, user mobile phone viruses or malicious network attack behaviors, and any other technical, internet, communication line, content infringement, and other reasons), users agree that we have the right to interrupt or terminate part or all of FrameElf services at any time. We will notify users as soon as possible in a reasonable manner and try to repair it at the first opportunity. However, we do not assume any responsibility for users' inability to send and receive read information or receive wrong information as a result, and users must bear the above risks.
3.2 Users understand that we need to periodically or non-periodically maintain and repair the service platform or related equipment. If such situations cause service interruption within a reasonable period, we will notify you in advance if possible but need not bear any responsibility for this.
3.3 If users provide false personal information, violate laws and regulations, national policies, or the usage rules stipulated in this Agreement, we have the right to interrupt or terminate the provision of FrameElf services under this Agreement to users at any time without bearing any responsibility to users or any third party.
4. Usage Rules
4.1 When applying for FrameElf service registration, users must provide accurate subject materials to us (when users are individuals, including name, gender, date of birth, phone, email, etc.; when users are units, including name, registered address, registration number, etc.). If there are any changes to the subject materials, they must be updated promptly. Users shall bear any losses caused to both parties or third parties due to the authenticity of the materials provided.
4.2 After successful registration, users will receive a FrameElf account and password set by users. Users are responsible for maintaining this user account and password; users shall bear relevant legal responsibilities for all behaviors under this user account.
Users must follow these principles when using FrameElf services:
(1) Comply with relevant laws and regulations;
(2) Not use FrameElf services for any illegal purposes;
(3) Comply with all network protocols, regulations, and procedures related to network services;
(4) Not use FrameElf service system to conduct any behavior that might adversely affect the normal operation of the internet;
(5) Not use FrameElf network service system to conduct any behavior unfavorable to us.
4.3 Users shall not use FrameElf services to create, upload, send, or spread sensitive information and information that violates national legal systems, including but not limited to the following information:
(1) Opposing the basic principles established in the Constitution;
(2) Endangering national security, leaking state secrets, subverting state power, or undermining national unity;
(3) Damaging national honor and interests;
(4) Inciting ethnic hatred, ethnic discrimination, or undermining ethnic unity;
(5) Undermining national religious policies or promoting cults and feudal superstitions;
(6) Spreading rumors, disrupting social order, or undermining social stability;
(7) Spreading obscenity, pornography, gambling, violence, murder, terror, or instigating crimes;
(8) Insulting or defaming others, infringing upon others' legal rights and interests;
(9) Containing other content prohibited by laws and administrative regulations.
4.4 Users agree not to use other users' accounts or passwords under any circumstances. When you suspect someone else is using your account or password, you agree to notify us immediately.
4.5 Users have the right to change, delete personal information, registration information, and transmitted content in FrameElf services, but deleting relevant information will also delete any text and images you store in the system. Users need to bear this risk.
4.6 If users violate any terms in this Agreement, we have the right to terminate services to the breaching users' FrameElf account according to this Agreement.
4.7 If users do not log in to their FrameElf account for a long time after registration, we have the right to recycle the account to avoid resource waste. Any problems arising from this shall be borne by users themselves.
5. Intellectual Property
5.1 Any text, images, logos, audio, video materials included in our services are protected by copyright, trademark rights, patent rights, and other property law.
5.2 Without the consent of relevant rights holders and us, the above materials shall not be displayed on any other third-party platform or used for any other commercial purposes; users shall not copy, modify, compile the above content, or create derivative products related to the content without authorization.
6. Privacy Protection
6.1 The "privacy" referred to in this Agreement includes the content of user personal information stipulated in Article 4 of the "Provisions on the Protection of Personal Information of Telecommunications and Internet Users" and the content that should be included in privacy as clearly stipulated in laws and regulations that will be formulated or revised in the future.
6.2 Protecting user privacy and personal data is one of our basic systems. We will take various institutional, security technology, and procedural measures to protect user privacy and personal data from unauthorized access, use, or disclosure, and ensure that we will not disclose individual users' registration information and non-public content stored in us to third parties other than cooperative units or use them for any illegal purposes, except in the following cases:
(1) Obtaining explicit authorization from users in advance;
(2) According to relevant laws and regulations requirements;
(3) According to relevant government authorities' requirements;
(4) To maintain public interests;
(5) When necessary to maintain our legal rights and interests in cases where users infringe upon our legal rights and interests under this Agreement.
6.3 Users need to provide some necessary information when registering for a FrameElf APP account or using APP services, such as: name, phone, email, gender, date of birth, name, registered address, registration number, etc. To provide account registration services or conduct user identity verification, users need to fill in their phone numbers; some functions require users to authorize access to their cameras or photo albums; some functions require users to authorize access to their phone contacts, etc. If users do not authorize or provide complete information, they cannot use this service or will be restricted during use. For information authorized and provided by users, we promise to take measures to protect users' personal information security.
6.4 To provide better user experience and improve FrameElf APP service quality, we may collect, use, or provide users' non-personal privacy information to third parties. We will supervise and manage such third parties' use of user personal data and make every possible effort to protect users' personal information security.
7. Disclaimer
7.1 Users shall comply with national laws, regulations, and policy provisions when using FrameElf services and bear any legal responsibility for the information and content they create, upload, send, and spread, which has nothing to do with us.
7.2 If any information and content displayed or pushed to users on FrameElf APP pages are searched, located, and matched from any third-party website on the internet using technical means according to user instructions rather than created by us unilaterally, then such displayed and pushed information and content do not represent our and FrameElf APP's views, and we are not responsible for the accuracy and correctness of such information.
7.3 Any text, images, logos, audio, video materials included in our FrameElf APP services are for teaching purposes only and do not involve any commercial activities of physical items.
7.4 If any information and content displayed or pushed to users on FrameElf APP pages are suspected of infringing any third party's intellectual property rights, rights holders and relevant stakeholders should send rights notices to us. After verification, we have the right to take measures including but not limited to disconnecting links to such infringing content or deleting and stopping transmission of such infringing content according to relevant laws and regulations, but we do not bear legal responsibility for such infringing content.
7.5 Users agree to compensate us and keep us harmless from any third-party claims, demands, or losses, including reasonable attorney fees, resulting from or arising out of users' violation of the provisions of this Agreement.
8. Other Terms
8.1 We have the right to modify any terms of this Agreement at any time. Once the content of this Agreement changes, we will announce the modified agreement content on the FrameElf APP platform or inform users of the modified content through other appropriate means. Users who do not agree with the above modifications have the right to choose to stop using FrameElf services, but continued use will be considered as accepting our modifications to relevant terms of this Agreement.
8.2 If any terms stipulated in this Agreement are partially or wholly invalid or unenforceable for any reason, the remaining terms of this Agreement shall remain valid and binding.
8.3 The conclusion, execution, interpretation, and dispute resolution of this Agreement shall be governed by applicable laws. If both parties have any disputes or controversies regarding the content or execution of this Agreement, they should first resolve them through friendly negotiation. If negotiation fails, either party may file a lawsuit with the court of competent jurisdiction where we are located.
8.4 The copyright of this Agreement belongs to us, and we reserve the final interpretation right and modification right of the contents of various terms of this Agreement.
